Allgemeine Geschäftsbedingungen der Lissi GmbH für die Indentitätsmanagement-Applikation „Lissi ID-Wallet“

1. Geltung der allgemeinen Geschäftsbedingungen

1.1 Diese Allgemeinen Geschäftsbedingungen („AGB“) gelten für die Nutzung der Identitätsmanagement-Applikation „Lissi ID-Wallet“ (“App”, „Lissi ID-Wallet“). Die AGB können jederzeit auf der Website „http://www.lissi.id “ abgerufen und eingesehen werden.

1.2 Sowohl die Nutzung der App „Lissi ID-Wallet“ und etwaige hiermit zusammenhängende Leistungen und Dienste als auch die Erbringung etwaiger mit der App „Lissi ID-Wallet“ in Zusammenhang stehender Leistungen und Dienste unterliegen den Bestimmungen dieser AGB.

1.3 Die Lissi GmbH ermöglicht den Nutzern mittels der App „Lissi ID-Wallet“ Zugang zu selbstbestimmten Identitätsnetzwerken gemäß den Maßgaben dieser AGB.

1.4 Andere allgemeine Geschäftsbedingungen, insbesondere solche des Nutzers, gelten nicht, und zwar auch dann nicht, wenn dies seitens des Nutzers gewünscht wird, deren Geltung von dem Nutzer erklärtermaßen vorausgesetzt wird und/oder die Lissi GmbH in Ansehung dessen die App „Lissi ID-Wallet“ zur Verfügung stellt oder Leistungen und/oder Dienste gegenüber dem Nutzer vorbehaltlos erbringt.

1.5 Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, so soll hierdurch die Wirksamkeit der AGB im Übrigen nicht berührt werden. Die Lissi GmbH und der Nutzer verpflichten sich bereits jetzt, auf die Verhandlungswege eine neue Regelung zu vereinbaren, die dem Zweck der unwirksamen Regelung möglichst nahekommt, jedoch gleichzeitig die Gründe berücksichtigt, weswegen diese unwirksam ist.

1.6 Entsprechendes (Ziffer 1.5) gilt bei Vertragslücken.

2. Leistungsgegenstand und Umfang der App „Lissi ID-Wallet“

2.1 Bei der App “Lissi ID-Wallet” handelt es sich um eine Applikation für die Verwaltung von digitalen Nachweisen für natürliche Personen. Über die App „Lissi ID-Wallet“ können natürliche Personen Identitätsinformationen über sich selbst von anderen Teilnehmern erhalten und in der App „Lissi ID-Wallet“ speichern und diese bei Bedarf mit weiteren Teilnehmern teilen. Identitätsinformationen können dabei Legitimationsdaten, Zahlungsverkehrsdaten, Anmeldedaten, digitale Nachweise und jegliche Informationen, die in Textform, als Bild oder als PDF-Dokument gespeichert werden können, sein.

Bei der App “Lissi ID-Wallet” handelt es sich um eine noch nicht fertig entwickelte und getestete Applikation, deren Nutzung auch nur im Rahmen von Testszenarien zulässig ist. Damit richtet sich die App speziell an Softwareentwickler, die mit den potentiellen Risiken von Testsoftware vertraut sind. Aufgrund der Eigenschaft der App als Testsoftware ist ein Einsatz in Produktivumgebungen nicht zulässig, was sowohl den direkten Einsatz in Produktivumgebungen wie auch die indirekte Anbindung an solche Produktivumgebungen ausschließt. Dies gilt auch für die Beta version der Lissi ID-Wallet.

Die App “Lissi ID-Wallet” verbindet sich dafür mit einem Identitätsnetzwerk für selbstbestimmte Identitäten und baut Peer-to-Peer Verbindungen mit anderen Teilnehmern auf. Durch die aufgebauten Verbindungen können verschlüsselte Nachrichten zwischen dem Nutzer und anderen Teilnehmern ausgetauscht werden. So können andere Teilnehmer dem Nutzer über die Peer-to-Peer Verbindungen Identitätsinformationen senden (sogenannte “Nachweise”). Die Identitätsinformationen kann der Nutzer in der App “Lissi ID-Wallet” speichern und verwalten. Andere Teilnehmer können ihrerseits über die Peer-to-Peer Verbindung Identitätsinformationen vom Nutzer anfragen (sogenannte “Datenabfrage” oder “Informationsanfrage”), die der Nutzer mit den bereits gespeicherten Identitätsinformationen beantworten kann. Vom Nutzer beantwortete Identitätsanfragen werden in der App „Lissi ID-Wallet“ protokolliert und diesem angezeigt.

Die App ist mit einem digitalen Postfachservice (“Mediation Agent”) verbunden, der von der Lissi GmbH betrieben wird. Nachrichten von Teilnehmern des Netzwerks an Nutzer der App “Lissi ID-Wallet” werden von den Teilnehmern in verschlüsselter Form an den Postfachservice gesendet und von dem Postfachservice an den Nutzer weitergeleitet. Nach erfolgreicher Zustellung der Nachrichten an den Nutzer, werden die Nachrichten vom Postfachservice gelöscht. Sollte das Gerät, auf dem der Nutzer die App installiert hat, nicht zu erreichen sein, so werden die Nachrichten so lange auf dem Postfachservice gespeichert, bis die Nachrichten an den Nutzer zugestellt werden konnten.

Die maximale Größe aller Nachrichten, die je Nutzer im digitalen Postfachservice gespeichert werden können, ohne dass sie vorher zugestellt wurden, beträgt 250 MB. Werden die 250 MB überschritten, so können solange keine weiteren neuen Nachrichten mehr gespeichert werden, bis wieder Nachrichten an das Gerät auf dem der Nutzer die App installiert hat zugestellt werden können. Sollte das Gerät, auf dem der Nutzer die App installiert hat, mehr als drei Monate nicht zu erreichen sein, so behält sich die Lissi GmbH vor, die Nachrichten endgültig aus dem Postfachservice zu löschen. Eine Zustellung der Nachrichten an das Gerät des Nutzers ist in diesem Fall nicht mehr möglich. Da die Nachrichten verschlüsselt sind, hat die Lissi GmbH zu keiner Zeit Zugriff auf den Inhalt der Nachrichten.

Für die Nutzung des Postfachservice wird eine Installations-ID des Nutzers gespeichert. Ein Rückschluss auf den Nutzer ist durch die Lissi GmbH nicht möglich, soweit die Installations-ID des Nutzers nicht öffentlich gemacht wurde, wozu alleine der Nutzer in der Lage ist und worauf damit die Lissi GmbH keinen Einfluss hat. Die Installations-ID ist nur für die Dauer einer Installation der „Lissi ID-Wallet“-App gültig und verliert ihre Gültigkeit, wenn die App auf dem Gerät des Nutzers deinstalliert wird.

Als zusätzliche Funktion bietet die App zudem die Möglichkeit, physische Plastikkarten mit Barcode oder QR-Code einzuscannen und in digitalisierter Form in der App auf dem Mobiltelefon des Nutzers zu speichern. Auf Android können sogenannte Pkpass-Dateien in der App auf dem Mobiltelefon des Nutzers gespeichert und verwaltet werden.

Die „Lissi ID-Wallet“-App bietet dem Nutzer zudem die Möglichkeit, ein Backup über die in der App gespeicherten Informationen zu erstellen und verschlüsselt mit einem Sicherungsschlüssel auf einem Speicherplatz seiner Wahl abzulegen.

2.2 Eine Nutzung der App „Lissi ID-Wallet“ durch Personen, die noch nicht das 16. Lebensjahr vollendet haben oder die nicht geschäftsfähig sind, ist unzulässig.

3. Anwendung und Funktionsweise der App „Lissi ID-Wallet“

Beim Starten der App “Lissi ID-Wallet” auf dem (internetfähigen und regelmäßig mobilen) Endgerät (nachfolgend auch „Mobiltelefon“), wird der Nutzer zunächst aufgefordert, ein neues “Lissi ID-Wallet” anzulegen oder ein bestehendes “Lissi ID-Wallet” wiederherzustellen. Anschließend wird der Nutzer aufgefordert, die Geschäftsbedingungen und Datenschutzbestimmungen zu akzeptieren und den Zugang zur App mit der Eingabe einer sechsstelligen Zahlenkombination (PIN) zu schützen. Für einen schnellen Zugang zur App besteht zusätzlich die Möglichkeit, die App anstelle einer PIN mit Biometrie zu entsperren. Hierfür ist die Biometriefunktion des Mobiltelefons für den Zugang zur App zu aktivieren.

Tab-Menü

Die App „Lissi ID-Wallet“ bietet im Tab-Menü vier Schaltflächen zur Auswahl: „Wallet“, „Kontakte”, „Einstellungen“ und “QR-Code Scanner”.

Unter “Wallet“ werden dem Nutzer die auf der App gespeicherten Identitätsinformationen in Form von einzelnen (Karten-)symbolen angezeigt. Drückt der Nutzer ein solches Kartensymbol, dann werden detaillierte Informationen zu den gespeicherten Identitätsinformationen angezeigt.

Unter “Kontakte” werden dem Nutzer alle bestehenden Peer-to-Peer Verbindungen zu anderen Teilnehmern/Institutionen und dazugehörige Informationen angezeigt. Wählt der Nutzer einen Kontakt aus, so werden dem Nutzer alle Nachrichten, Daten und Anfragen, die der Nutzer von dem Kontakt erhalten hat und an den Kontakt gesendet hat, angezeigt. Neue Kontaktanfragen von Teilnehmern werden in der App als Kontaktanfrage angezeigt. Interaktionen mit neuen Kontakten können erst durchgeführt werden, nachdem ein Kontakt von dem Nutzer angenommen wurde.

Unter „Einstellungen“ stehen die folgenden Einstellungsoptionen zur Verfügung:

● Sicherheit

○ „Pin ändern“ – hier kann der 6-stellige PIN geändert werden, welcher als Alternative zu Biometrie notwendig ist, um Zugang zu der App „Lissi ID-Wallet“ zu erhalten

○ “Mit Biometrie anmelden” hier kann der Nutzer die Authentifizierung (zusätzlich zu PIN und Passwort) über biometrische Merkmale (z.B. Fingerabdruck oder Gesichtserkennung) seines Mobiltelefons aktivieren

● Wiederherstellung

○ „Backup erstellen“ – hier kann der Nutzer ein Backup für in der Lissi Wallet gespeicherte Daten erstellen. Hierfür muss der Nutzer einen aus 12 Wörtern bestehenden Sicherungsschlüssel notieren und dauerhaft aufbewahren sowie eine Backup-Datei an einem sicheren Datenspeicher seiner Wahl ablegen. Achtung: Ohne den Sicherungsschlüssel und die dazugehörige Backup-Datei ist die Wiederherstellung eines Backups von zuvor gespeicherten Informationen nicht möglich und die Informationen sind für immer verloren. Der Sicherungsschlüssel muss an einem sicheren Ort, geschützt vor dem Zugriff von Dritten, aufbewahrt werden, um einen Missbrauch durch Dritte zu verhindern.

○ „Wallet wiederherstellen“ – ermöglicht die Wiederherstellung im Wallet gespeicherter Daten aus einer zuvor gespeicherten Backup-Datei. Zur Wiederherstellung muss zunächst eine Backup-Datei importiert werden und danach der Sicherheitsschlüssel bestehend aus 12 Schlüsselwörtern eingegeben werden. Achtung: Bei der Wallet Wiederherstellung mittels einer Backup-Datei, werden alle im aktuellen Wallet befindlichen Daten überschrieben und gehen dauerhaft verloren.

○ „Sicherungsschlüssel“ – hier kann der aus 12 Wörtern bestehende Sicherheitsschlüssel eingesehen werden

● Allgemein

○ „Sprache ändern“ - hier kann die Sprache der App angepasst werden

○ „Lissi Demo testen“ – ermöglicht eine Demo mit der Lissi-App durchzuführen

○ Geschäftsbedingungen - zeigt die aktuellen Geschäftsbedingung für die App “Lissi” an

Über die “QR-Code Scanner” Schaltfläche am unteren rechten Ende der App erhält der Nutzer Zugang zu einem QR-Code-Scanner. Mit Hilfe des QR-Code Scanners können Verbindungsanfragen von anderen Teilnehmern in Form eines QR-Codes geöffnet werden, Informationsanfragen von anderen Teilnehmern geöffnet werden, sowie Bar-Codes oder QR-Codes von Mitgliedskarten, Rabattkarten oder Tickets gescannt und in der Lissi-App in digitalisierter Form abgelegt werden.
Zur Nutzung des QR-Code Scanners benötigt die App Zugriff auf die Kamera des Telefons.

Funktionsweise

Verbindungen aufbauen

Für den Aufbau einer Peer-to-Peer Verbindung erhält der Nutzer entweder einen QR-Code oder einen Link von einem anderen Teilnehmer. Nachdem der QR-Code gescannt bzw. der Link geöffnet wurde, erhält der Nutzer eine Information, von wem die Kontaktanfrage gesendet wurde. Die App „Lissi ID-Wallet“ überprüft dafür eine Liste bekannter Teilnehmer, die durch die Lissi GmbH gepflegt wird oder ermittelt die Informationen über die Teilnehmer aus von diesen mitgesendeten digitalen Zertifikaten (sog. „Extended Organisation Validation Certificate“ bzw. "Qualified Website Authentication Certificate“). Im Fall, dass ein Teilnehmer der App über die Liste bekannt ist oder ein gültiges „Extended Organisation Validation Certificate“ bzw. ein gültiges "Qualified Website Authentication Certificate“ vorliegt und der Name des Teilnehmers mit dem Namen der Organisation im Zertifikat übereinstimmt, wird der Teilnehmer als „Kontakt ist verifiziert“ angezeigt. Sollte dies nicht der Fall sein, wird der Teilnehmer als „Kontakt ist nicht verifiziert“ angezeigt.

Kontaktanfragen können angenommen oder abgelehnt werden. Im Fall, dass der Kontakt nicht verifiziert ist, empfehlen wir die Kontaktanfrage abzulehnen. Es besteht das Risiko, dass sich Organisationen unberechtigt als Dritte ausgeben, die sie in Wirklichkeit nicht sind und versuchen, unberechtigt an Daten des Nutzers zu gelangen.

Nach Annahme der Kontaktanfrage wird eine Peer-to-Peer Verbindung mit dem Teilnehmer hergestellt und im Tab-Menü unter „Kontakte“ angezeigt. Bestehende Kontakte können jederzeit im “Lissi ID-Wallet” des Nutzers wieder gelöscht werden.

Wurde eine bestehende Peer-to-Peer Verbindung mit einem Teilnehmer erstellt, so kann dieser Teilnehmer dem Nutzer Nachrichten senden, Identitätsinformationen (“Nachweise”) ausstellen oder Informationsanfragen „Datenabfrage“ zu gespeicherten Identitätsinformationen senden.

Identitätsinformationen empfangen und speichern

Werden dem Nutzer neue Identitätsinformationen von einem Teilnehmer angeboten, so werden diese dem Nutzer im Tab „Kontakte“ als neue Nachricht unter dem jeweiligen Teilnehmer angezeigt.

Öffnet der Nutzer den Nachweis, erhält er Details zum Nachweis und die Möglichkeit, den Nachweis anzunehmen oder abzulehnen. Nimmt der Nutzer den Nachweis an, so wird dieser Nachweis gespeichert und mittels eines neuen Kartensymbols im Tab „Wallet“ angezeigt.

Gespeicherte Identitätsinformationen teilen

Teilnehmer können dem Nutzer Informationsanfragen „Datenabfrage“ zu gespeicherten Identitätsinformationen senden. Informationsanfragen werden im Tab „Kontakte“ als neue Nachricht unter dem jeweiligen Teilnehmer angezeigt. Öffnet der Nutzer die Kontaktanfrage erscheinen die angefragten Informationen.

Die Beantwortung der angefragten Informationen wird bereits mit den in der App gespeicherten Attributen ausgefüllt (die der Nutzer zuvor von anderen oder demselben Teilnehmer erhalten hat). Der Nutzer erhält die Möglichkeit, diese Informationen manuell zu tauschen, soweit weitere passende Identitätsinformationen vorhanden sind.

Die Speicherung der Daten des Nutzers bei Teilnehmern, die Identitätsinformationen anfragen, erfolgt durch diese Teilnehmer, die insofern für die rechtskonforme Handhabung der Daten verantwortlich sind. Auf Seiten der Lissi GmbH bestehen dahingehend weder Einflussnahmemöglichkeiten noch Verantwortlichkeiten oder Pflichten. Die App „Lissi ID-Wallet“ ist insofern nur für die Übermittlung der Informationen zwischen den Teilnehmern verantwortlich. Sind die angefragten Identitätsinformationen nicht auf der App gespeichert, so erhält der Nutzer eine entsprechende Fehlermeldung angezeigt. Eine Beantwortung der Informationsanfrage ist zu diesem Zeitpunkt nicht möglich. Die fehlende Information muss dem Nutzer erst von einem Teilnehmer, der über die dahingehend benötigte Information verfügt, bereitgestellt werden, bevor die Anfrage beantwortet werden kann. Wenn der anfragende Teilnehmer es zulässt, besteht auch die Möglichkeit der manuellen Eingabe von Informationen durch den Nutzer. In diesem Fall wird ein manuelles Eingabefeld angezeigt, welches durch den Nutzer auszufüllen ist. Wenn der Nutzer die Informationsanfrage nicht beantworten möchte, kann er sie ablehnen. In diesem Fall werden keine Informationen an den anfragenden Teilnehmer gesendet und der durch die Anfrage des Teilnehmers begonnene Prozess wird beendet.

Die Historie der erfolgreich beantworteten Informationsanfragen sieht der Nutzer einschließlich der präsentierten Daten im Tab “Wallet“ durch das Klicken auf den abgefragten Nachweis im Abschnitt “Aktivitäten” oder im Tab “Kontakte” unter der jeweiligen Verbindung mit dem jeweils anfragenden Teilnehmer.

Netzwerk-Unterstützung

Die „Lissi ID-Wallet“-App unterstützt derzeit mehrere Hyperledger Indy-basierte Netzwerke, darunter u.a. das IDunion-Testnetzwerk, das Staging-, Builder- und Mainnet von Sovrin, den BCovrin Ledger sowie das Indicio-Netzwerk. Die Unterstützung bestimmter Netzwerke liegt allein im Ermessen der Lissi GmbH. Die Lissi GmbH gibt keine Garantien, dass bestimmte Netzwerke auch in Zukunft unterstützt werden. Weitere Netzwerke werden von Zeit zu Zeit hinzugefügt, ohne dass Nutzer hierfür separat informiert werden. Nutzende haben auch die Möglichkeit, selbst neue Netzwerke hinzuzufügen.

4. Anmeldung/Registrierung

4.1 Für die Nutzung der App „Lissi ID-Wallet“ ist keine Anmeldung und Registrierung bei der Lissi GmbH erforderlich. Die Lissi GmbH stellt dem Nutzer nur die App „Lissi ID-Wallet“ zur Verfügung, mit der sich der Nutzer mit einem Identitätsnetzwerk verbinden und Identätsdienstleistungen von Dritten in Anspruch nehmen kann.

4.2 Soweit der Nutzer im Zusammenhang mit der Nutzung der App „Lissi ID-Wallet“ sowie aller hiermit in Zusammenhang stehenden Aktivitäten und Dienste das Internet und Internetzugänge benötigt und nutzt, so liegt dies ausschließlich in seiner Verantwortungssphäre wie auch sämtliche hierdurch ausgelösten Kosten (einschließlich anfallender Kosten von Telekommunikationsdiensten), welche von dem Nutzer zu tragen sind.

5. Nutzung der App „Lissi ID-Wallet“ durch den Nutzer

5.1 Nach Installation der App „Lissi ID-Wallet“ können seitens des Nutzers die App „Lissi ID-Wallet“ sowie etwaige mit der App „Lissi ID-Wallet“ verbundenen Leistungen und Dienste der Lissi GmbH durch den Nutzer gemäß den Maßgaben dieser AGB genutzt werden.

5.2 Der Schutz der App vor unberechtigter Verwendung obliegt ebenso wie die (sachgerechte) Nutzung der App „Lissi ID-Wallet“ in der ausschließlichen Verantwortlichkeit des Nutzers. Dies umfasst insbesondere auch die Pflicht des Nutzers, die App „Lissi ID-Wallet“ durch geeignete Sicherheitsvorkehrungen und Schutzmechanismen vor unbefugtem Zugriff Dritter sowie vor schädlichen Einwirkungen durch Schadsoftware zu schützen, sowie regelmäßige Backups zu erstellen und die entsprechenden Sicherungsschlüssel und Backup-Dateien ebenfalls durch Sicherheitsvorkehrungen und Schutzmechanismen vor Zugriff Dritter zu schützen.

5.3 Ebenso liegt der Schutz und die rechtskonforme Handhabung von personenbezogenen Daten einschließlich aller Ausweisdaten, die im Rahmen der Nutzung der App „Lissi ID-Wallet“ verwendet oder benötigt werden oder die in den Besitz des Nutzers gelangen, ausschließlich in der Verantwortlichkeit des Nutzers.

5.4 Jegliche Änderungen der App „Lissi ID-Wallet“ sind verboten. Insbesondere ist es Nutzern nicht gestattet, Mechanismen der Zugangs- oder Nutzungskontrolle der App „Lissi ID-Wallet“ zu ändern oder zu umgehen oder die App „Lissi ID-Wallet“ (ganz oder in Teilen) in einer nicht vorgesehenen Art und Weise zu nutzen.

5.5 Auf Seiten des Nutzers besteht die Pflicht, die App „Lissi ID-Wallet“ stets auf dem neuesten Stand zu halten und insbesondere alle zur Verfügung stehenden Aktualisierungen („Updates“) unverzüglich vorzunehmen.

5.6 Weder besteht ein Anspruch auf Nutzung der App „Lissi ID-Wallet“ noch auf Nutzung einer bestimmten Version der App „Lissi ID-Wallet“.

5.7 Die Nutzung der App „Lissi ID-Wallet“ sowie die Nutzung der Daten, Inhalte, Informationen und Mitteilungen der App „Lissi ID-Wallet“ – einschließlich derjenigen, die über die App „Lissi ID-Wallet“ übermittelt werden – erfolgt auf eigene Verantwortlichkeit des Nutzers.

6. Verfügbarkeiten und Änderungen der App „Lissi ID-Wallet“ sowie von Leistungen in Bezug auf die App „Lissi ID-Wallet“

6.1 Die Lissi GmbH übernimmt keine Garantie, Einstandspflicht oder Haftung im Hinblick auf die Tauglichkeit und Geeignetheit der App „Lissi ID-Wallet“ und der mit der App „Lissi ID-Wallet“ verbundenen Leistungen und Dienste im Hinblick auf Zwecke und Ziele, die der Nutzer mit der Nutzung der App „Lissi ID-Wallet“ und der mit der App „Lissi ID-Wallet“ verbundenen Leistungen und Dienste verfolgt und beabsichtigt.

6.2 Die Lissi GmbH bemüht sich die App „Lissi ID-Wallet“ sowie die mit dieser verbundenen Leistungen und Dienste ohne Unterbrechung zur Verfügung zu stellen. Die Lissi GmbH übernimmt jedoch keine Garantie, Einstandspflicht oder Haftung für die Verfügbarkeit und Nutzbarkeit der App „Lissi ID-Wallet“ sowie der mit dieser verbundenen Leistungen und Dienste. Es ist dem Nutzer insofern bekannt, dass es jederzeit zu einer Beeinträchtigung oder auch zu einem vollständigen Ausfall der Nutzbarkeit der App „Lissi ID-Wallet“ kommen kann, ohne dass dies eine Verletzung von vertraglichen Pflichten der Lissi GmbH darstellen würde. Die Lissi GmbH wird zwar regelmäßig bemüht sein, solche Beeinträchtigungen oder Ausfälle zu beheben, eine dahingehende Pflicht besteht jedoch nicht. Ebenso besteht seitens der Lissi GmbH keine Pflicht, erkannte Fehler der App „Lissi ID-Wallet“ zu beheben, dahingehende Warnungen oder Unterrichtungen auszusprechen oder diese aus sonstigen Gründen zu aktualisieren oder an (tatsächliche oder rechtliche) Anforderungen anzupassen.

6.3 Auch unabhängig von äußeren Umständen, auf die Lissi GmbH keinen Einfluss hat, ist die Lissi GmbH berechtigt, die Nutzung der App „Lissi ID-Wallet“ sowie der mit dieser verbundenen Leistungen und Dienste jederzeit auszusetzen oder zu beenden, wobei Dauer und Art der Aussetzung und Zeitpunkt der Beendigung gemäß eigener, insbesondere nicht gerichtlich nachprüfbarer Ermessensausübung seitens der Lissi GmbH erfolgen und insbesondere nicht auf Instandsetzungen oder Wartungsarbeiten beschränkt sind.

6.4 Die Lissi GmbH ist berechtigt, jederzeit die Erbringung von mit der App „Lissi ID-Wallet“ in Zusammenhang stehenden Leistungen und Diensten zu beenden. Dies bedarf keiner Gründe und kann insbesondere im Rahmen eigener, insbesondere nicht gerichtlich nachprüfbarer Ermessensausübung durch die Lissi GmbH erfolgen.

6.5 Die Lissi GmbH ist jederzeit berechtigt, den Betrieb der App „Lissi ID-Wallet“ zu ändern oder einzustellen und/oder Änderungen an der App „Lissi ID-Wallet“ vorzunehmen, wobei über Art und Umfang solcher Änderungen gemäß eigener, insbesondere nicht gerichtlich nachprüfbarer Ermessensausübung seitens der Lissi GmbH entschieden wird. Es besteht keine Verpflichtung, den Nutzer über entsprechende Änderungen zu unterrichten.

6.6 Die Lissi GmbH ist nicht verpflichtet, Alt-Versionen der App „Lissi ID-Wallet“ zu pflegen oder im Hinblick auf diese Leistungen zu erbringen.

7. Zustimmung zur Verwendung von Daten und Informationen des Nutzers

7.1 Der Nutzer erklärt im Rahmen des Installierungsprozesses der App „Lissi ID-Wallet“ durch das Anklicken des entsprechenden Feldes die Zustimmung zu diesen AGB insgesamt und damit insbesondere auch zu folgenden Punkten:

Die in der App gespeicherten Identitätsdaten des Nutzers werden zunächst nur in der App „Lissi ID-Wallet“ und somit auf dem Endgerät des Nutzers gespeichert und nicht an Dritte oder die Lissi GmbH in unverschlüsselter Form weitergeleitet. Eine Weitergabe der Daten erfolgt nur durch die Zustimmung des Nutzers durch Beantwortung einer Informationsanfrage durch einen anfragenden Teilnehmer.

Der Nutzer erhält, soweit ermittelbar, im Rahmen der App „Lissi ID-Wallet“ eine Übersicht, welche Informationen er welchem Teilnehmer zu welchem Zeitpunkt gesendet hat. Die Weiterleitung von Informationen des Nutzers an andere Teilnehmer über die App „Lissi ID-Wallet“ ist ausschließlich Angelegenheit des anderen Teilnehmers und des Nutzers und entzieht sich der Einflussnahmemöglichkeit der Lissi GmbH. Die App „Lissi ID-Wallet“ ist dahingehend nur für den Austausch der Identitätsinformationen zuständig.

Zur Verbesserung der Nutzererfahrung erstellt die App „Lissi ID-Wallet“ bei Fehlern oder Abstürzen der Anwendung automatisierte Absturzberichte, diese enthalten neben einem Fehlerbericht, der den Grund des Absturzes enthält, weitere Daten wie das Datum und die Uhrzeit des Absturzes, der Modellname des verwendeten Gerätes, die installierte Betriebssystemversion, die eingestellte Sprache und das Land des Nutzers.

Die Anwendung verwendet Analysewerkzeuge die basierend auf der Nutzung der App „Lissi ID-Wallet“, anonymisierte Daten erheben, welche eine statistische Auswertung der folgenden Merkmale ermöglichen: Anzahl der Nutzer in bestimmten Zeiträumen, Verteilung der Modelle auf denen die App installiert wurde, tägliche Nutzung der Anwendung pro (anonymisiertem) Nutzer, Land der Installation, vorausgewählte Sprache des Nutzers sowie die verwendete Version der App.

7.2 Die Lissi GmbH erhebt, mit Ausnahme der Installations-ID, keine personenbezogenen Daten der Nutzer.

7.3 Eine weitere Verwendung der Daten durch die Lissi GmbH erfolgt nur mit dem ausdrücklichen Einverständnis des Nutzers. Bezüglich der Einzelheiten wird auf die Datenschutzerklärung von der Lissi GmbH verwiesen, welcher der Nutzer im Rahmen des Installierungsprozesses der App „Lissi ID-Wallet“ durch das Anklicken des entsprechenden Feldes der Nutzer zustimmt und die – ebenso wie die AGB - jederzeit auf der Website der „http://www.lissi.id “ abgerufen und eingesehen werden kann.

8. Pflichten des Nutzers

8.1 Der Nutzer ist verpflichtet, ausschließlich wahrheitsgemäße und vollständige Daten und Informationen zur Verfügung zu stellen. Der Nutzer ist insbesondere verpflichtet, in keiner Weise Angaben zu machen oder die App „Lissi ID-Wallet“ bzw. die hinsichtlich der App „Lissi ID-Wallet“ erbrachten Leistungen und Dienste in einer Weise zu nutzen, die eine Identität vorspiegelt, die nicht mit der tatsächlichen Identität des Nutzers übereinstimmt. Von der Verpflichtung ausgeschlossen sind Angaben im Rahmen von Tests von Anwendungsfällen und Systemen.

8.2 Der Nutzer verpflichtet sich, seine durch die App „Lissi ID-Wallet“ erzeugte und bestätigte Identität nicht anderen zur Nutzung gegenüber Dritten zur Verfügung zu stellen und/oder anderen an seiner Stelle die Nutzung der auf ihn lautenden Vorgaben/Identität gegenüber Dritten zu ermöglichen.

8.3 Dem Nutzer ist es nicht gestattet, die App „Lissi ID-Wallet“ Dritten zur Verfügung zu stellen. Diese darf jeweils nur originär von der Lissi GmbH bzw. von seitens der Lissi GmbH entsprechend berechtigten Plattformen originär durch das Herunterladen erworben werden. Demgemäß ist auch bei Geräten, auf denen die App „Lissi ID-Wallet“ installiert ist, darauf zu achten, dass vor deren (vorübergehender oder endgültigen) Überlassung oder Weitergabe an Dritte die App „Lissi ID-Wallet“ vollständig gelöscht und deinstalliert wird. Dies erfolgt im Übrigen auch im Sinne des Nutzers, da nur so sichergestellt ist, dass der Dritte nicht Zugriff auf die Daten Informationen erhält, aus denen sich die Identität des Nutzers ableiten lässt.

8.4 Dem Nutzer ist es verboten, die App und Leistungen und Dienste, die sich auf die App „Lissi ID-Wallet“ beziehen, in einer Weise zu nutzen, die in täterschaftlicher oder teilnehmender Weise Straftatbestände oder Ordnungswidrigkeiten erfüllen würden.

8.5 Dem Nutzer ist bekannt, dass die Lissi GmbH verpflichtet sein kann, auf behördliche und/oder polizeiliche Anforderung hin den entsprechenden Behörden oder öffentlich-rechtlichen Stellen Informationen und/oder Daten, die die Lissi GmbH gem. Ziffer 6.2 erhoben hat, zur Verfügung zu stellen, die die Person des Nutzers betreffen. Der Nutzer ist hiermit ungeachtet ohnehin bestehender gesetzlicher Regelungen, die die Herausgabe legitimieren, einverstanden, sodass eine entsprechende Herausgabe seitens der Lissi GmbH auf entsprechende Anforderung hin stets in rechtmäßiger Weise erfolgt.

9. Lizenz

9.1 Die Lissi GmbH räumt dem Nutzer ein einfaches, räumlich unbeschränktes, nicht ausschließliches, nicht übertragbares und nicht unterlizenzierbares Nutzungsrecht an den der App „Lissi ID-Wallet“ ein.

9.2 Dieses Nutzungsrecht wird nicht für eine bestimmte Dauer und damit unbefristet erteilt, jedoch mit dem Recht seitens der Lissi GmbH, dieses nach eigener, insbesondere nicht gerichtlich nachprüfbarer Ermessensausübung jederzeit mit sofortiger Wirkung beenden und entziehen zu können, ohne dass es hierfür irgendwelcher Gründe bedürfte.

10. Vergütung

10.1 Die Bereitstellung der “Lissi ID-Wallet” und deren Nutzung erfolgt für den Nutzer unentgeltlich.

10.2 Durch die Nutzung der App „Lissi ID-Wallet“ können jedoch auf Seiten des Nutzers Entgelte und Gebühren anfallen, so etwa Verbindungs- und Übertragungsentgelte, die vom Nutzer zu tragen sind.

11. Haftung

11.1 Die Lissi GmbH haftet für Schäden, für die der Lissi GmbH gleich aus welchem Rechtsgrund einzustehen hat, nach Maßgabe der folgenden Bestimmungen.

11.2 Für Schäden, die durch fahrlässiges (nicht jedoch grob fahrlässiges) Verhalten verursacht worden sind, haftet die Lissi GmbH nicht. Dies gilt insbesondere auch für indirekte Schäden wie entgangener Gewinn, entgangener Umsatz, fehlgeschlagene Aufwendungen sowie Schäden Dritter.

11.3 Beschränkungen jeglicher Haftung gelten nicht bei Vorsatz oder grober Fahrlässigkeit oder in Fällen, in denen eine Verletzung von Leib, Leben oder Gesundheit stattgefunden hat.

11.4 Beschränkungen der Haftung gelten ferner nicht für Inanspruchnahmen aus dem Produkthaftungsgesetz nach den dort geltenden Vorschriften.

12. Gerichtsstand

12.1 Diese AGB sowie sämtliche Nutzungen der App „Lissi ID-Wallet“ sowie der in Bezug auf die App „Lissi ID-Wallet“ seitens der Lissi GmbH erbrachten Leistungen und Dienste unterliegen dem Recht der Bundesrepublik Deutschland, unter Ausschluss des UN-Kaufrechts („C.I.S.G“).

12.2 Erfüllungsort und ausschließlicher Gerichtsstand für alle Rechtsstreitigkeiten, die sich aus oder im Zusammenhang mit diesem AGB sowie sämtlichen Nutzungen der App „Lissi ID-Wallet“ sowie der in Bezug auf die App „Lissi ID-Wallet“ seitens der Lissi GmbH erbrachten Leistungen und Dienste ergeben, ist Frankfurt am Main (Deutschland).

General Terms and Conditions (GTC) of Lissi GmbH for the identity management application "Lissi ID-Wallet"

1. Validity of the General Terms and Conditions

1.1 These General Terms and Conditions ("GTC") apply to the use of the "Lissi ID-Wallet" identity management application ("”Lissi ID-Wallet” App"). The GTC can be accessed and viewed at any time on the website of "http://www.lissi.id ".

1.2 Both the use of the „Lissi ID-Wallet“ App and related services and the provision of all services and benefits associated with the „Lissi ID-Wallet“ App are subject to the provisions of these GTC.

1.3 Lissi GmbH provides users with access to self-sovereign identity networks via the "Lissi ID-Wallet" app in accordance with the provisions of these GTC.

1.4 Other general terms and conditions, in particular those of the user, do not apply, even if this is desired by the user, if the validity of general terms and conditions of the user are assumed by the user and if Lissi GmbH makes the „Lissi ID-Wallet“ App available in consideration hereof or provides services and/or benefits to the user without reservation in that respect.

1.5 Should a provision of these GTC be or become invalid, the validity of the remaining provisions of these GTC shall not be affected. Lissi GmbH and the user undertake to agree on a new provision by way of negotiation, which comes as close as possible to the purpose of the invalid provision, but at the same time takes into account the reasons why it is invalid.

1.6 The same applies (clause 1.5) in the case of contractual gaps.

2. Subject matter and scope of the "Lissi ID-Wallet" app

2.1 The "Lissi ID-Wallet" app is an application for the management of digital credentials of natural persons. Via the "Lissi ID-Wallet" app, natural persons can obtain identity information about themselves from other participants and store it in the "Lissi ID-Wallet" app and share it with other participants if required. Identity information can be identification data, payment transaction data, login data, digital proofs and any information that can be stored in text form, as an image or as a PDF document.

The app "Lissi ID-Wallet" connects to an identity network for self-sovereign identities and establishes peer-to-peer connections with other participants. Through the established connections, encrypted messages can be exchanged between the user and other participants. Thus, other participants can send identity information to the user via the peer-to-peer connections (so-called "credentials"). The user can store and manage the identity information in the app "Lissi ID-Wallet".

The app "Lissi ID-Wallet" is an application that is not yet fully developed and tested. Its use is only permissible within the context of test scenarios. The app is specifically intended for software developers who are familiar with the potential risks of test software. Due to the nature of the app as test software, its deployment in production environments is not allowed. This includes both direct use in production environments and indirect integration with such production environments. This also applies to the beta version of the Lissi ID-Wallet.

Other participants can in turn request identity information from the user via the peer-to-peer connection (so-called "data request" or "information request"), which the user can answer with the identity information already stored. Identity requests answered by the user are logged within the app "Lissi ID-Wallet" and displayed to the user.

The app is connected to a digital mailbox service ("Mediation Agent") operated by Lissi GmbH. Messages from participants of the network to users of the "Lissi ID-Wallet" app are sent by the participants to the mailbox service in encrypted form and forwarded by the mailbox service to the user. After successful delivery of the messages to the user, the messages are deleted by the mailbox service. If the device on which the user has installed the app cannot be reached, the messages will be stored on the mailbox service until the messages could be delivered to the user.

The maximum size of all messages that can be stored per user in the digital mailbox service without having been delivered beforehand is 250 MB. If the 250 MB are exceeded, no further new messages can be stored until messages can be delivered to the device on which the user has installed the app. If the device on which the user has installed the app cannot be reached for more than three months, Lissi GmbH reserves the right to permanently delete the messages from the mailbox service. In this case, delivery of the messages to the user's device is no longer possible. Because the messages are encrypted, Lissi GmbH has no access to the content of the messages at any time.

For the use of the mailbox service, an installation ID of the user is stored. It is not possible for Lissi GmbH to draw conclusions about the user, as long as the installation ID of the user has not been made public, which only the user is able to do and Lissi GmbH has no influence on. The installation ID is only valid for the duration of an installation of the "Lissi ID-Wallet" app and loses its validity when the app is uninstalled on the user's device.

As an additional function, the app also offers the option of scanning physical plastic cards with barcodes or QR codes and saving them in digitized form in the app on the user's mobile phone. On Android, so-called Pkpass files can be stored and managed in the app on the user's mobile phone.

The "Lissi ID-Wallet" app also offers the user the option of creating a backup of the information stored in the app and storing it encrypted with a backup key in a storage location of the user's choice.

2.2 Use of the "Lissi ID-Wallet" app by persons who have not yet reached the age of 16 or who are not legally competent is not permitted.

3. Use and Functioning of the "Lissi ID-Wallet" App

When starting the "Lissi ID-Wallet" app on the (Internet-capable and regularly mobile) end device (hereinafter also referred to as "mobile phone"), the user is first prompted to create a new "Lissi ID-Wallet" or to restore an existing "Lissi ID-Wallet". The user is then requested to accept the terms and conditions and privacy policy and to protect access to the app by entering a six-digit number combination (PIN). For quick access to the app, it is also possible to unlock the app with biometrics instead of a PIN. To do this, the biometric function of the mobile phone must be activated for access to the app.

Tab menu

The app "Lissi ID-Wallet" offers four buttons for selection in the tab menu: "Wallet", "Contacts", "Settings" and "QR Code Scanner".

Under "Wallet", the identity information stored on the app is displayed to the user in the form of individual (card) symbols. If the user presses one of these card symbols, detailed information about the stored identity information is displayed.

Under "Contacts", the user is shown all existing peer-to-peer connections to other participants/institutions and related information. If the user selects a contact, all messages, data and requests that the user has received from and sent to the contact are displayed to the user. New contact requests from participants are displayed in the app as a contact request. Interactions with new contacts can only be carried out after a contact has been accepted by the user.

The following setting options are available under "Settings":

● Security

○ "Change PIN" - here the 6-digit PIN can be changed, which is necessary as an alternative to biometrics in order to gain access to the "Lissi ID-Wallet" app.

○ "Unlock wallet with biometrics" - here the user can activate authentication (in addition to PIN and password) via biometric features (e.g. fingerprint or facial recognition) of their mobile phone.

● Backup

○ "Wallet backup" - here the user can create a backup for data stored in the Lissi Wallet. To do this, the user must write down a 12-word backup key and keep it permanently, as well as store a backup file in a secure data storage location of their choice. Caution: Without the backup key and the corresponding backup file, it is not possible to restore a backup of previously stored information and the information is lost forever. The backup key must be stored in a safe place, protected from access by third parties, to prevent misuse by third parties.

○ "Recover Backup" - allows data stored in the Wallet to be restored from a previously saved backup file. To restore, a backup file must first be imported and then the security key consisting of 12 keywords must be entered. Caution: When restoring the wallet using a backup file, all data in the current wallet will be overwritten and permanently lost.

○ "Backup phrase" - here the security key consisting of 12 words can be viewed.

● General

○ "Change language" - here the language of the app can be adjusted

○ "Lissi Demo" - enables a demo to be carried out with the Lissi app

○ Terms and conditions - displays the current terms and conditions for the "Lissi" app

The "QR Code Scanner'' button at the bottom right of the app gives the user access to a QR code scanner. With the help of the QR code scanner, connection requests from other participants can be opened in the form of a QR code, information requests from other participants can be opened, and barcodes or QR codes from membership cards, discount cards or tickets can be scanned and stored in the Lissi app in digitized form. To use the QR code scanner, the app requires access to the phone's camera.

How it works

Establishing connections

To establish a peer-to-peer connection, the user receives either a QR code or a link from another participant. After the QR code has been scanned or the link opened, the user receives information about who sent the contact request. For this purpose, the app "Lissi ID-Wallet" checks a list of known participants, which is maintained by Lissi GmbH, or determines the information about the participants from digital certificates sent by them (so-called "Extended Organisation Validation Certificate" or "Qualified Website Authentication Certificate"). If a participant is known to the app via the list or a valid "Extended Organisation Validation Certificate" or a valid "Qualified Website Authentication Certificate" is available and the name of the participant matches the name of the organisation in the certificate, the participant is displayed as "Contact is verified". If this is not the case, the participant is displayed as "Contact is not verified".

Contact requests can be accepted or rejected. In the case that the contact is not verified, we recommend rejecting the contact request. There is a risk that organisations may unauthorisedly impersonate third parties that they are not in reality and attempt to obtain the user's data without authorisation.

After accepting the contact request, a peer-to-peer connection is established with the participant and displayed in the tab menu under "Contacts". Existing contacts can be deleted from the user's "Lissi ID-Wallet" at any time.

If an existing peer-to-peer connection has been created with a participant, this participant can send messages to the user, issue identity information ("credentials") or send information requests "information request" on stored identity information.

Receiving and saving identity information

If new identity information is offered to the user by a participant, it will be displayed to the user in the "Contacts" tab as a new message under the respective participant.

If the user opens the credential, he or she will receive details of the credential and the option to accept or reject the credential. If the user accepts the credential, this credential is saved and displayed by means of a new card symbol in the "Wallet" tab.

Sharing stored identity information

Participants can send the user information request about stored identity information. Information requests are displayed in the "Contacts" tab as a new message under the respective participant. When the user opens the contact request, the requested information appears.

The response to the requested information is already filled in with the attributes stored in the app (which the user has previously received from other or the same participant). The user is given the option to manually swap this information if other matching identity information is available.

The storage of the user's data by participants requesting identity information is carried out by these participants, who are responsible in this respect for the legally compliant handling of the data. In this respect, Lissi GmbH has neither the possibility to exert influence nor any responsibilities or duties. In this respect, the "Lissi ID-Wallet" app is only responsible for the transmission of information between the participants. If the requested identity information is not stored on the app, the user will receive a corresponding error message. A response to the information request is not possible at this point. The missing information must first be provided to the user by a participant who has the required information before the request can be answered. If the requesting participant allows it, it is also possible for the user to enter information manually, so-called “self-attested” information. In this case, a manual input field will be displayed for the user to fill in. If the user does not wish to answer the information request, he/she can reject it. In this case, no information is sent to the requesting participant and the process started by the participant's request is terminated.

The user can see the history of successfully answered information requests, including the presented data, in the "Wallet" tab by clicking on the queried record in the "Activities" section or in the "Contacts" tab under the respective connection with the respective requesting participant.

Network support

The "Lissi ID-Wallet" app currently supports several Hyperledger Indy-based networks, including but not limited to the IDunion test network, Sovrin's staging, builder and mainnet, the BCovrin Ledger and the Indicio network. Support of specific networks is solely at the discretion of Lissi GmbH. Lissi GmbH makes no guarantees that specific networks will be supported in the future. Further networks will be added from time to time without users being informed separately. Users also have the option of adding new networks themselves.

4.1 No login and registration with Lissi GmbH is required to use the „Lissi ID-Wallet“ App. Lissi GmbH only provides the user with the „Lissi ID-Wallet“ App, which allows the user to connect to an identity network and to use the identity services of third parties.

4.2 Insofar as the user requires and uses the internet and internet access in connection with the use of the "Lissi ID-Wallet" app and all activities and services related thereto, this shall be exclusively the responsibility of the user, as shall all costs incurred as a result thereof (including any costs incurred for telecommunications services).

5. Use of the "Lissi ID-Wallet" app by the user

5.1 Once the "Lissi ID-Wallet" app has been installed, the user may use the "Lissi ID-Wallet" app and any services of Lissi GmbH associated with the "Lissi ID-Wallet" app in accordance with the provisions of these GTC.

5.2 The protection of the app against unauthorised use is the exclusive responsibility of the user, as is the (proper) use of the "Lissi ID-Wallet" app. In particular, this also includes the user's obligation to protect the "Lissi ID-Wallet" app from unauthorised access by third parties and from the harmful effects of malware by means of suitable security precautions and protective mechanisms, as well as to create regular backups and to protect the corresponding backup keys and backup files from access by third parties by means of security precautions and protective mechanisms.

5.3 Likewise, the protection and legally compliant handling of personal data, including all identity information used or required in the context of the use of the "Lissi ID-Wallet" app or which come into the possession of the user, is the sole responsibility of the user.

5.4 Any changes to the "Lissi ID-Wallet" app are prohibited. In particular, users are not permitted to change or circumvent mechanisms of access or usage control of the "Lissi ID-Wallet" app or to use the "Lissi ID-Wallet" app (in whole or in part) in a manner not intended.

5.5 The user is obliged to keep the "Lissi ID-Wallet" app up to date at all times and in particular to carry out all available updates without delay.

5.6 There is no entitlement to use the "Lissi ID-Wallet" app or to use a particular version of the "Lissi ID-Wallet" app.

5.7 The use of the "Lissi ID-Wallet" app and the use of the data, content, information and messages of the "Lissi ID-Wallet" app - including those transmitted via the "Lissi ID-Wallet" app - is the sole responsibility of the user.

Availability of and changes to the "Lissi ID-Wallet" app and services relating to the "Lissi ID-Wallet" app

6.1 Lissi GmbH assumes no guarantee, obligation or liability with regard to the suitability of the „Lissi ID-Wallet“ App and the services and benefits associated with the „Lissi ID-Wallet“ App with regard to the purposes and objectives that the user pursues and intends to achieve by using the „Lissi ID-Wallet“ App and the services and benefits associated with the „Lissi ID-Wallet“ App. .

6.2 Lissi GmbH tries to make App "Lissi ID-Wallet" and the services and benefits associated with it available without interruption. However, Lissi GmbH assumes no guarantee, obligation or liability for the availability and usability of the „Lissi ID-Wallet“ App and the services and benefits associated with it.

In this respect, the user is aware that the usability of the "Lissi ID-Wallet" app may be impaired or even fail completely at any time without this constituting a breach of contractual obligations on the part of Lissi GmbH. Although Lissi GmbH will regularly endeavour to remedy such impairments or failures, there is no obligation to do so. Likewise, Lissi GmbH has no obligation to correct detected errors in the "Lissi ID-Wallet" app, to issue warnings or notifications to this effect or to update it for other reasons or to adapt it to (actual or legal) requirements.

6.3 Also independent of external circumstances beyond the control of Lissi GmbH, Lissi GmbH is entitled to suspend or terminate the use of the „Lissi“ App as well as the services and performances and services associated with it at any time, whereby the duration and type of suspension and the time of termination are at the discretion of Lissi GmbH, in particular not subject to judicial review, and in particular not limited to repair or maintenance work.

6.4 Lissi GmbH is entitled to terminate the provision of services associated with the "Lissi ID-Wallet" app at any time. This does not require any reasons and can in particular take place within the framework of Lissi GmbH's own exercise of discretion, which is in particular not subject to judicial review.

6.5 Lissi GmbH is entitled at any time to change or discontinue the operation of the "Lissi ID-Wallet" app and/or to make changes to the "Lissi ID-Wallet" app, whereby the nature and scope of such changes will be decided by Lissi GmbH in accordance with its own exercise of discretion, in particular not subject to judicial review. There is no obligation to inform the user of such changes.

6.6 Lissi GmbH is not obliged to maintain old versions of the "Lissi ID-Wallet" app or to provide services with regard to them.

7. Consent to the use of data and information of the user

7.1 During the installation process of the „Lissi“ App, the user declares his agreement to these GTC as a whole and thus in particular to the following points by clicking on the corresponding field:

The user's identity data stored in the app will initially only be stored in the "Lissi ID-Wallet" app and thus on the user's device and will not be forwarded to third parties or Lissi GmbH. The data is only passed on with the user's consent by responding to a request for information by an enquiring participant.

The user receives, as far as ascertainable, an overview within the framework of the app "Lissi ID-Wallet", which information he or she has sent to which participant at which time. The forwarding of information from the user to other participants via the "Lissi ID-Wallet" app is exclusively a matter for the other participant and the user and is beyond the control of Lissi GmbH. In this respect, the "Lissi ID-Wallet" app is only responsible for the exchange of identity information.

In order to improve the user experience, the "Lissi ID-Wallet" app generates automated crash reports in the event of errors or crashes of the application. In addition to an error report containing the reason for the crash, these reports contain further data such as the date and time of the crash, the model name of the device used, the operating system version installed, the language set and the country of the user.

The application uses analysis tools that, based on the use of the app "Lissi ID-Wallet", collect anonymised data that enable a statistical evaluation of the following characteristics: Number of users in certain time periods, distribution of the models on which the app was installed, daily use of the app per (anonymised) user, country of installation, preselected language of the user and the version of the app used.

7.2 With the exception of the installation ID, Lissi GmbH does not collect any personal data of the users.

7.3 Any further use of the data by Lissi GmbH will only take place with the express consent of the user. With regard to the details, reference is made to the data protection declaration of Lissi GmbH, which the user agrees to during the installation process of the app "Lissi ID-Wallet" by clicking on the corresponding field of the users and which - as well as the GTC - can be retrieved and viewed at any time on the website of "http://www.lissi.id ".

8. Obligations of the user

8.1 The User is obliged to provide only truthful and complete data and information. In particular, the user is obliged not to provide information in any way or to use the "Lissi ID-Wallet" app or the services provided with regard to the "Lissi ID-Wallet" app in a way that simulates an identity that does not correspond to the user's actual identity.

8.2 The user undertakes not to make his identity generated and confirmed by the „Lissi ID-Wallet“ App available to others for use vis-à-vis third parties and/or to enable others in his/her place to use the specifications/identity made in his/her name vis-à-vis third parties.

8.3 The user is not permitted to make the "Lissi ID-Wallet" app available to third parties. This may only be acquired originally from Lissi GmbH or from platforms authorised by Lissi GmbH by downloading it. Accordingly, it must also be ensured for devices on which the "Lissi ID-Wallet" app is installed that the "Lissi ID-Wallet" app is completely deleted and uninstalled prior to their (temporary or permanent) transfer or passing on to third parties. This is also in the interest of the user, as this is the only way to ensure that the third party does not gain access to the data information from which the identity of the user can be deduced.

8.4 The User is prohibited from using the app and services and performances that relate to the „Lissi ID-Wallet“ App in a manner that would constitute a criminal offence or regulatory offence in a criminal or participatory manner.

8.5 The user is aware that Lissi GmbH may be obligated to provide information and/or data that Lissi GmbH has collected pursuant to Section 6.2 to the relevant authorities or public-law entities upon official and/or police request, which relate to the person of the user. The user agrees to this, regardless of any existing legal regulations that legitimize the publication, so that a corresponding publication on the part of Lissi GmbH upon request is always made in a lawful manner.

9. Licence

9.1 Lissi GmbH grants the user a simple, territorially unlimited, non-exclusive, non-transferable and non-sublicensable right of use to the „Lissi ID-Wallet“ App.

9.2 This right of use is not granted for a specific period of time and therefore indefinitely, but with the right on the part of Lissi GmbH to be able to terminate and withdraw this right at any time with immediate effect at its own discretion, in particular without judicial review, without any need for any reasons.

10. Remuneration

10.1 The provision of the "Lissi ID-Wallet" and its use is free of charge for the user.

10.2 However, the use of the „Lissi ID-Wallet“ App may give rise to fees and charges on the part of the user, such as connection and transmission fees, which must be borne by the user.

11. Liability

11.1 Lissi GmbH is liable for damages for which Lissi GmbH is responsible, regardless of the legal grounds, in accordance with the following provisions.

11.2 Lissi GmbH is not liable for damages caused by negligent (but not grossly negligent) conduct. This applies in particular also to indirect damages such as lost profits, lost sales, failed expenditures as well as damages of third parties.

11.3 Furthermore, limitations of liability shall not apply to claims arising from the Product Liability Act in accordance with the regulations applicable there.

11.4 Limitations of liability shall furthermore not apply to claims under the Product Liability Act in accordance with the provisions applicable therein.

12. Jurisdiction

12.1 These GTC as well as all uses of the „Lissi ID-Wallet“ App and the services and performances provided by Lissi GmbH in relation to the „Lissi ID-Wallet“ App are subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods ("C.I.S.G").

12.2 The place of performance and exclusive place of jurisdiction for all legal disputes arising from or in connection with these GTC and all uses of the „Lissi ID-Wallet“ App as well as the services and performances rendered by Lissi GmbH in relation to the „Lissi“ App is Frankfurt am Main (Germany).
